Why does Bybit EU need to collect my tax information?
Since 1 January 2026, DAC8 has applied to reporting crypto-asset service providers. DAC8 requires such providers to conduct tax due diligence on users and to collect and report prescribed information concerning reportable users and reportable crypto-asset transactions to the competent tax authority. Bybit EU collects tax information to determine and comply with its applicable tax due-diligence and reporting obligations.
Who is required to submit tax information?
Bybit EU requires individual and business users to provide the requested tax residency and identification information so that it can determine and comply with its applicable reporting obligations. Providing tax information does not necessarily mean that every user or every transaction will be reportable.
What information do I need to prepare for tax reporting?
Depending on your circumstances, you may be required to provide information including:
- your name and date of birth;
- your country or countries of tax residence;
- your permanent address;
- your taxpayer identification number, or TIN;
- your country of citizenship or incorporation; and
- other information required to determine your tax reporting status.
Relevant transaction information is recorded by Bybit EU through its systems.
What happens if I do not submit the required tax information on time?
Failure to provide the requested information within the applicable timeframe may result in restrictions being placed on certain account features or services, in accordance with applicable law, the Bybit EU terms and Bybit EU’s compliance procedures.
How will my information be reported under DAC8?
Based on the tax residency and identification information you provide, Bybit EU GmbH may report prescribed user and transaction information to the competent tax authority, as required by applicable law.
This regulatory reporting does not constitute the preparation or filing of your personal tax return. You remain responsible for determining and complying with your individual tax obligations.
When will Bybit EU report the information to the tax authorities?
Bybit EU will collect the relevant information during the applicable reporting year and report it in accordance with the statutory reporting timetable. For example, prescribed information relating to the 2026 reporting year may be reported to the competent tax authority in 2027.
Will I be notified when a new reporting period starts?
You will generally only need to submit your tax information once. However, you are responsible for ensuring that the information remains accurate and up to date.
Bybit EU may ask you to review, confirm or resubmit your information if:
- your circumstances change;
- your Identity Verification information is updated;
- the information provided is incomplete or inconsistent; or
- further information is required under applicable law.
Can I change my information after submitting it?
Yes, you can update your tax information after submission. Please review all information carefully before submitting it. Bybit EU may ask you to provide or confirm updated information if your Identity Verification details or tax circumstances change.
How can I tell whether my tax information was submitted successfully?
After submitting your information, the Tax Center will display the relevant submission status, such as Submitted, together with a View button where available.
What happens if my tax residency changes before I submit my information?
You must submit accurate and current tax residency information. Where your tax residency has changed, provide information reflecting your current circumstances and include any additional tax residencies that must be declared.
Where can I update my tax residency information?
You can update your tax residency information by going to Account → Tax Center → Tax Overview → Tax Status → Change. You will then be asked to complete the relevant questionnaire. For security and verification purposes, changes to your tax status may be limited to once within a seven-day period.
What happens if my tax residency changes after I have submitted my information?
A change in your residence or personal circumstances may affect your tax residency status. You should update your information through the Tax Center. Bybit EU may also contact you by email, push notification or another available communication channel if updated or additional information is required.
Will my personal data be shared with third parties?
Your personal data may be disclosed to competent tax authorities, service providers and other recipients where required or permitted by applicable law and as described in the Bybit EU Privacy Policy. Bybit EU does not disclose personal data to unauthorised third parties.
Is my tax information stored securely?
Bybit EU applies appropriate technical and organisational measures designed to protect tax information during storage and transmission. Further information about how Bybit EU processes and protects personal data is available in the Bybit EU Privacy Policy.
Do I still need to submit tax information if I am not actively using my Bybit EU account?
Yes, Bybit EU may require tax information from users who maintain an account, even where the account is not actively used, so that it can determine and comply with its applicable tax due-diligence and reporting obligations. Whether information or transactions are reportable will be determined in accordance with applicable law.
Can I submit the required report directly to the tax authorities myself?
No, a user cannot replace Bybit EU’s regulatory reporting obligations by submitting information directly to a tax authority. Bybit EU may report prescribed information to the competent Austrian tax authority. That authority may exchange the information with the competent authorities of other jurisdictions in accordance with applicable law. All users, including Austrian residents, remain responsible for their own tax filings and individual tax obligations.
Where can I download the tax report?
If you are looking for the tax that you paid, you can download the tax records report from Account → Tax Center → Tax Records → Export. The yearly report will be generated every March 31st.
