1. Introduction and Scope

1.1. The following "Bybit Rewards Agreement" or "Agreement" supplements the "General Terms", which you can find here. In case of a conflict between the General Terms and this Bybit Rewards Agreement, this Bybit Rewards Agreement shall prevail.

 

1.2. Contracting party. The services as agreed upon in this Bybit Rewards Agreement are provided by Bybit EU GmbH ("Bybit CASP", "we", "us") to persons that have registered an "Account" with Bybit CASP ("User", "you"). The counterparty for all transactions under this Bybit Rewards Agreement is Bybit CASP.

2. Amendments of the Agreement

2.1. Notification and Consent for Changes to the Agreement

Whenever we intend to implement a change, we will notify you on paper or on another durable medium about the proposed amendments. 

 

Changes to this Agreement will become effective upon the earlier of (i) your express acceptance of the amended Agreement or (ii) two months after the notification of the changes, unless you have objected to these changes.

 

2.2. Objecting to a change / termination of the contractual relationship

Whenever we notify you of any changes, we will also inform you, (i) that if you do not object in text form or on the Platform within the two months' time frame before the changes come into effect, you will be deemed to have consented to the changes, and that (ii) you have the right to terminate the entire or parts of your contractual relationship that relate to the change without any notice period until the changes take effect. You will still have access to your Account during this period.

 

2.3. Exceptions for Changes to Services and Fees

The preceding paragraphs do not apply to restrictions to the services of the Company and to the User's fees for existing products.

3. Order process

3.1. A list of "Crypto-Assets" eligible for Bybit Rewards can be found here.

 

3.2. General. The User can subscribe an eligible Crypto-Assets to the service "Bybit Rewards". By subscribing, the User proposes to grant a Crypto-Asset loan to Bybit CASP for a fixed amount of time in return for a predetermined, fixed reward ("Yield").

 

3.3. Invitation. Any figures, numbers, or exchange reference prices on the Platform do not constitute binding offers from Bybit CASP but an invitation for you to submit a subscription offer.

 

3.4. To submit an offer for Bybit Rewards, you must (i) provide valid and correct data in response to each requirement on the Platform and (ii) click the relevant confirmation button.

 

3.5. Offer period. Bybit CASP will, within 30 minutes of the submission of your offer, decide, at its sole discretion, either to accept or decline it. During this 30 minute timeframe, you are bound by your offer.

 

3.6. Factual fulfilment. Bybit CASP can either accept your subscription offer by factual fulfillment (tatsächliche Erfüllung) or reject it.

 

3.7. Transfer of ownership. If Bybit CASP accepts the subscription offer, a full transfer of title over the loaned Crypto-Assets is effected from the User to Bybit CASP. Thus, the User is neither the economic owner (wirtschaftlicher Eigentümer) nor the legal owner (zivilrechtlicher Eigentümer) over these Crypto-Assets. Consequently, the subscribed Crypto-Assets are no longer custodied by Bybit CASP for the User but belong solely to Bybit CASP. Bybit CASP may use these Crypto-Assets at its own discretion for its own account. The User only has a (contractual) claim against Bybit CASP, arising from the subscription to the Bybit Rewards service and no direct ownership title or security interest to any of their loaned Crypto-Assets.

 

3.8. No investment strategy or fiduciary requirements. There is no obligation, whether express or implied, to use, invest, or deploy the loaned Crypto-Assets in any specific manner, for any particular purpose, or at all. The Yield (as described in Section 4.1 below) is independent of and shall not be affected by any loss or profit Bybit CASP may generate until the Crypto-Assets are retransferred to the User.

 

3.9. Transaction information. Immediately after accepting or rejecting your order, Bybit CASP will inform the User thereof. In the case of acceptance of the order, Bybit CASP will publish the following details regarding your transactions on the Platform: 

• Asset: The Crypto-Asset involved in the subscription;

• Date: The date and time the subscription was fulfilled;

• Yield: The Yield that the User will receive;

• Volume: The number of Crypto-Assets involved in the subscription.

 

This information will be made available to Users through the Platform’s interface and can help with tracking the trade history and the performance of the orders. 

4. Yield

4.1. Yield. The Yield is specified prior to the User's subscribing directly on the Platform and is indicated as annual percentage rate ("APR"). The APR and Yield are fixed upfront; this means that fluctuations in the market price of the underlying Crypto-Asset which may occur after the Bybit Rewards subscription request has been fulfilled, do not affect the Yield or APR. The Yield will start accruing on the calendar day following the calendar day on which the Bybit Rewards subscription request has been fulfilled and will end after the amount of days specified in your the Bybit Rewards subscription request. To calculate the specific Yield for any Bybit Rewards subscription, the following formula is used:

Yield = Amount of Crypto-Asset loaned × (APR / 365) × duration in days

 

4.2. The Yield accrued during the subscription period is recorded in the "Off-Chain Information Ledger" and settled with the User at the same time the subscribed Crypto-Assets are returned (this means when your subscription ends). The accrued Yield only displays a contractual claim against Bybit CASP until it is distributed after the fixed term ends.

 

4.3. Bybit Rewards does not support Yield compounding. This means that any already accrued Yield will not count towards the loaned principal amount of Crypto-Assets. The User can use the accrued Yield only in a subsequent Bybit Rewards subscription.

5. Repayment

5.1. The User cannot unsubscribe (demand repayment regarding) the Crypto-Assets prior to the end of the agreed upon fixed term. This does not exclude or impact any extraordinary termination right as laid out in the General Terms in Section 14.

 

5.2. Once the fixed term ends, the Crypto-Assets including accrued Yield are automatically transferred back to the User within 24 hours after the subscription ended. At this time, the User stops earning the specified fixed Yield.

6. Fees

6.1. There are no fees charged for using the Rewards Service. 

7. Liability

7.1. Any liability of Bybit CASP under or in connection with the services described herein shall be limited in accordance with Section 20 of the General Terms.
