Counterparty: Your counterparty for spot trading and borrowing crypto-assets is exclusively Bybit CASP.
MiCAR-regulated crypto-asset service: Exchange of crypto-assets for other crypto-assets (Art 3 para 1 no 16 lit d MiCAR)
For Spot Margin Trading you will borrow crypto-assets from Bybit CASP. Note that the lending and borrowing of crypto-assets is not regulated under MiCAR. As an unregulated service the lending and borrowing of crypto-assets is not subject to compliance requirements under MiCAR and you may experience a reduced level of protection.
This Document should be read together with the applicable Terms and Conditions (Margin Trading Agreement), other risk disclosure and policy documents provided by Bybit CASP. Please visit the additional information and help pages on the Bybit platform to read further information related to investing with Spot Margin Trading.
You are about to use a service that is not simple and may be difficult to understand. This service is not suitable for all (retail) clients. Before trading, please make sure that you understand the risks involved.

2 What is this service?
2.1 Type
Spot Margin Trading is a service that allows you to buy and sell higher volumes of specific cryptoassets, even if you currently own neither crypto-asset of the specific trading pair. With Spot Margin Trading, you buy and sell the actual crypto-assets, which will be safekept for you by Bybit CASP. You will not only acquire a contractual position. Spot Margin Trading is based on MiCARregulated crypto-asset exchange services with Bybit CASP as your exclusive counterparty for each exchange transaction. To provide you with the required additional purchase power, Bybit CASP grants you a loan in crypto-assets. You will be charged a continuous fee for the duration of the loan. The currently applicable fees will be displayed to you on the platform.
You can only use these crypto-asset loans to fulfill the exchange transactions under Spot Margin Trading. The extent of the loan that you may be eligible to receive depends on the calculated value of crypto-assets in your Unified Trading Account and the leverage level selected by you.
Only the exchange of crypto assets as well as the safekeeping of your crypto-assets is a regulated service under MiCAR. The crypto-asset loan provided to you as part of Spot Margin Trading is not regulated under MiCAR or any other regulatory financial markets regime. The protections and safeguards under MiCAR thus do not apply to the loan granted to you as part of Spot Margin
Trading.
2.2 Objectives
Spot Margin Trading is a high-risk product that involves the use of leverage and borrowed cryptoassets. Spot Margin Trading allows you to take positions on the price movements between two crypto-assets - either between two volatile assets or between a volatile asset and a (presumed stable) e-money token. While this may offer opportunities for profits, it equally exposes you to the risk of rapid and substantial losses.
If you want to enter a "long position" for a specific crypto-assets under Spot Margin Trading, you will borrow the respective other crypto-asset of the selected trading pair from Bybit CASP and with the borrowed crypto-assets acquire the crypto-assets, which you expect to increase in price. You will make a profit if the market price of the acquired crypto-asset increases relative to the market price of the borrowed crypto-assets. If the acquired crypto-asset instead falls in value, your losses may significantly exceed the price movement due to leverage and you will lose your crypto-assets.
If you want to enter a "short position" for a specific crypto-assets under Spot Margin Trading, you will borrow the crypto-asset, which you expect to fall in price, and sell these borrowed cryptoassets for the respective other crypto-asset of the selected trading pair. You will make a profit if the market price of the borrowed and sold crypto-assets falls relative to the market price of the acquired crypto-assets. If the borrowed crypto-asset instead increases in value, your losses can grow rapidly, especially at high leverage levels.
With Spot Margin Trading, you can enter into spot market transactions with leverage. This means that depending on your selected leverage level, you will be able to exercise larger trades relatively compared to the current crypto-assets held in your Unified Trading Account. This may result in proportionally bigger profits and losses. Even smaller price movements can already lead to significant losses (up to a total loss). If you fail to comply with the Maintenance Margin Rate requirements, you may be liquidated and will not be able to profit from any future positive price developments.
2.3 Term
Spot Margin Trading does not have a fixed term or expiry date.
Bybit CASP will grant you the crypto-asset loan for an unlimited time, provided you comply with the applicable loan terms, especially complying with the required Maintenance Margin Rate. In case you do not comply with the applicable terms, especially if you exceed the maximum Maintenance Margin Rate requirement, the loan will immediately become due and potentially all crypto-assets in your Unified Trading Account are subject to liquidation (Cross Margin).
Under Spot Margin Trading you cannot open specific contractual positions. However, similar to "closing a contractual position", you may end your exposure under Spot Margin Trading by repaying the crypto-asset loan to Bybit CASP.
It is recommended to maintain open loan positions under Spot Margin Trading only for a very short time ([1] day). Over longer periods you may face significant costs due to the applicable fee structure. However, in principle, you could maintain an open position under Margin Trading for multiple days, weeks or months.
2.4 Intended Retail Clients:
Spot Margin Trading is targeted at experienced and knowledgeable retail clients, who are familiar with leveraged products. The retail clients must have the specific interest to use speculative products and services with high-risk exposure.
The retail client should be comfortable and experienced in employing effective asset and risk management techniques. Targeted retail clients must be able to bear a significant and up to total loss of their crypto-assets.
3 What are the risks, and what could you get in return?
Spot Margin Trading is considered high risk. Should you decide to use Spot Margin Trading your assets are exposed to a high risk of loss. Spot Margin Trading is of significant higher risk compared to other products and services provided by Bybit MiCAR, including standard spot trading without leverage.
Spot Margin Trading is based on Cross Margin using your Unified Trading Account as collateral. This potentially exposes all crypto-assets held in your Unified Trading Account to the risk of liquidation. You may lose your full investment and all crypto-assets held in your Unified Trading Account.
Spot Margin Trading is not covered by any investor protection scheme or insurance.
Under Spot Margin Trading you are always exposed to the market price development of both crypto-assets of your selected trading pair. Further, due to Cross Margin, the market price development of all crypto-assets held in your Unified Trading Account may impact your Maintenance Margin Rate and impact your risk of liquidation.
You will acquire crypto-assets through spot market transactions, thus, you are exposed to the inherent technical risks of these crypto-assets and underlying blockchains technology.
4 What happens if Bybit CASP is unable to pay out?
Under Spot Margin Trading you will acquire crypto-assets as part of spot market transactions, which will be safekept by Bybit CASP for you. You will not only acquire a contractual/obligatory position against Bybit CASP to receive a potential future payment.
Nonetheless, Bybit CASP may face (temporary) restrictions to exchange your crypto-assets or to allow you the withdrawal of your crypto-assets. In such cases, the access to or the power of disposition over your crypto-assets may be limited.
Spot Margin Trading is not covered by any investor compensation scheme or insurance to satisfy your potential claims against Bybit CASP.
5 What are the costs?
You enter into spot market transactions and will face the applicable trading fees as well as spread. You will be charged a fee denominated in the borrowed asset for the duration of the loan, which will accrue hourly. Furthermore, depending on your loan repayment method, you may be charged an additional fee.
Due to these fees, you may still face losses in neutral or favorable market conditions.
You will be charged additional fees if you are subject to liquidation.

6 How long should you maintain positions, and when can you exit?
The recommended holding period is less than 1 day.
Crypto-asset loans granted by Bybit CASP are not subject to mandatory minimum or maximum loan terms. Spot Margin Trading is also not subject to other mandatory minimum holding periods. You may buy or sell your crypto-assets at any time and repay your borrowed crypto-assets at any time.
